    Default Hacked RAY discussion removed

    rscott4581,

Take it elsewhere - just because you say (shout) again and again that you think it is OK to not abide by the CC-BY license - that does not make it true.

Your posts on ModMySite about this are not welcome here - please refrain from posting about your hacked RAY.

    Thanks,

You know - I am not sure how to answer this question in fact - it is all very murky and confusing and frustrating.

All I can say is that the NULL RAY was / is a blatant attempt to remove the need to license Ray - when in fact - BoonEx is well within their rights to expect license fees to be paid.

Maybe if future conversations are a bit more "low-key" they would be OK - the one that was recently deleted had gotten out of hand and drawn too much attention to itself.

    Hope that explanation helps.

rscott4581 sent me a PM about this - and I just got around to answering it - as I was on the road most of this past week.

    I said in my reply:

The basic thing about the CC-BY license is that - they can set the rules on how they want to be attributed for the work.

They are more or less saying that...

    1) do not remove the headers from the code
    2) do not remove the links at the bottom of each page back to boonex
    3) do not alter the license check code that checks if a license is installed / valid.

Now - does this mean all the links in the LINKS section can go? Does it mean the ads can go in RAY or ORCA?

I am not sure - since we sort of only talked to them about Dolphin (in regards to CLEAN, which has no Ray or Orca).

For CLEAN, we will abide by 1,2,and 3 above -as this is what was communicated to us in the email from Boonex posted in the license discussion thread in "negative karma".

But - RAY / ORCA, I don't know what their requirements are.

It does appear that removing the ads/links goes against their wishes under CC-BY for RAY and ORCA.

But it should be confirmed with them.

As for the general things about NULL and so on of any of the BoonEx products - we (ModMySite) once again feels that the pricing on the licenses is reasonable - and that we should not condone blatant and obvious (read into that as you wish) threads on ModMySite touting NULLing or otherwise altering the applications in a way that affects BoonEx's income stream - to do so is just not fair to BoonEx.

We (ModMySite) has a reasonably good relationship with BoonEx at this time - as in, we answer each other emails - and have not "fought" in some months about anything - and this is perhaps best for both ModMySite and BoonEx going forward.

We have only one "deal" with BoonEx, and this is for the bulk purchases of Dolphin licenses (not Ray or Orca) where we receive a moderate discount. We mostly buy them to give to our support and modification customers as gifts - not as a revenue stream.

Once again - $39 is not a lot for Dolphin... really. As for Ray - I don't know - that can add up if you purchase all the modules - and I have my doubts about is scalability. Orca, $39 bucks - but problems in browsers.

But what we mostly focus on is Dolphin - and $39 a year ($3.25USD) a month is affordable and reasonable.

Due to that - NULLing and disable license checks should be a minor concern, and a minor presence, on ModMySite.

My 2 1/2 cents on the topic.

I agree with Smoge that the small fee for dolphin is not that expensive. However for Ray it is highly expensive considering it has ads, and you have to pay for each individual one. Even though RAY is supposed to be a package.

Here is a very valid point Smoge.

First off. Boonex is not going to come after anyone. They do not scare anyone.

However keeping this in mind, let me just say this. Your community here is a large part of the Boonex company whether they like the existence or not. You Smoge do not have to do anything they say. However you do, which is fine and very professional of you. However, I think since you do support their request you need to set the precedence with them and say... "I am more than happy to help comply with your request and I will continue to not support nulling of your product on my forums, however Boonex needs to recognize my site as a huge contributor and make an effort to help us and provide us with clear and concise information when we need it."

Something along those lines and probably more. I mean, what do you owe them. You are doing them a favor, and they can not ignore the fact that if anyone searches for Boonex and/or Dolphin, they are going to find this site.

    Google Boonex

    Google Dolphin Community Software

You are on the first page of all the searches.

    Default Ray/Orca Hacking

As I understand it the license doesn't say that Ray has to be used so removal or using an alternative is not breaking any licensing rules issued by Boonex.

However 'hacking' is a severe breach of an agreed contract between the user(your website) and Boonex. As much as it pains me to say hacking Ray is definately not a path others should follow. If you don't like Ray find an alternative.

If you've read some of my other posts you will know I am not a fan of Ray, in fact I hate it, but breaking the law is not the solution, webmasters doing so should be aware that if the owner (Boonex.com) finds out you are breaking several (worldwide) laws relating to breach of contract and of course a breach of licensing(also a contract) you will be liable for prosecution.

Just to be clear 'mods' improve or as the term suggests modifies a script, within the boundaries set by the copyright owner, hacking breaches copyright by altering a script when terms clearly state you can't.

    Default ray license

Here is a copy of the ray license included in the ray package. This license is also included at the top of all ray files. There is no reference to a "CC-BY license". and nowhere dose it have any wording about removing references to Boonex or any subsidiaries nor any licensing requirements. It dose however clearly state you can modify in any way for personal usage. This could include hacking, nulling or an all out rape on the script.

And Smoge I fully under stand your position in this matter. If Boonex has a problem with this then they should hire a qualified legal professional to draft a better license agreement.
    That's my 2 cent's on this issue.
